General Conditions of Sale
It has been agreed between the parties that L'Endormi will rent to the Traveler the accommodation as described below under the following conditions:
Failure by the Traveler to comply with the following provisions will automatically result in the cancellation of their reservation (even if it has started) without the Traveler being entitled to any reimbursement or compensation.
- PURPOSE OF THE RENTAL AGREEMENT
These terms and conditions govern lendormi.com's sales of short-term furnished apartment accommodations. The accommodation is located at the address indicated in the reservation.
2. CONDITIONS OF RENTAL
L'Endormi rents the accommodation to the Traveler for the period indicated in their reservation. The stay is non-renewable. L'Endormi expressly undertakes to have fully vacated the accommodation on the departure date by 11 a.m. at the latest and to return the keys to L'Endormi.
The number of people present is indicated in the Number of Travelers section, access to the apartment is not authorized to third parties other than those who are part of the reservation under penalty of cancellation of the reservation without being able to claim any refund or compensation. At the start of the rental, L'Endormi will give the traveler the keys and instructions relating to the accommodation.
The Parties have agreed to set the rental price indicated in the reservation for the entire duration of the stay.
In order to proceed with the reservation of accommodation, the Traveler must provide the information requested during the reservation (copy of their identity document and contact details).
Travelers of foreign origin must complete the “Police Form” at the time of their reservation, otherwise it will be void.
L'Endormi informs the Traveler that it is his responsibility to check with his insurance company that he has valid holiday insurance and civil liability insurance.
3. PRICE
All orders, regardless of their origin, are payable in euros.
lendormi.com reserves the right to modify its prices at any time, but the product will be invoiced based on the price in effect at the time the order is validated and subject to availability.
The products remain the property of the company lendormi.com, including during the tenants' stay.
4. CAUTION
The day before entering the premises, the Traveler authorizes L'Endormi to make a deposit (credit card imprint) of an amount indicated in the Details section in order to cover damage and/or deterioration of the accommodation and the furniture and objects furnishing the accommodation caused by the Tenant, as well as loss of keys or objects.
This deposit will be returned to the Traveler 48 hours after departure, provided that the accommodation is returned in its initial condition when the keys are returned.
5. OBLIGATIONS OF THE LESSEE
Animals and smoking are not permitted in the accommodation.
No noise likely to disturb neighbors. The use of speakers or other music players is prohibited. Discretion is requested between 10 p.m. and 8 a.m. in the building's common areas.
Internet use is permitted in compliance with Hadopi laws.
To prevent the possibility of illegal activity in the accommodation, third parties are not permitted to enter the reservation. L'Endormi reserves the right to contact the relevant authorities if this is not the case.
The Traveler will not be able to exercise any recourse against L'Endormi in the event of theft or damage to the accommodation.
The traveler learned that the entire building is under video surveillance with recording.
6. AVAILABILITY
If a product is unavailable after the reservation has been made, the traveler will be notified by email. The order will either be automatically canceled and no bank debit will be made, or we will offer to find you alternative accommodation for the duration of your stay.
7. ACCES INTERNET
"The Traveler, when accessing the internet, undertakes not to use this access for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without authorization. The Traveler is informed that sharing software, when connected to the internet, can automatically make downloaded files available. If sharing software has been used to download protected works, it is therefore preferable to deactivate it.
The Traveler is also required to comply with the security policy defined by L'Endormi as well as the rules for using the network and computer equipment.
This responsibility of the access holder does not in any way exclude that of the Traveler who may be accused of an offense of counterfeiting (article L. 335-3 of the Intellectual Property Code)”.
8. CANCELLATION
All reservations are final and non-refundable. L'Endormi will retain the entire reservation amount in the event of cancellation.
9. APPLICABLE LAW IN THE EVENT OF DISPUTES
The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, the Clermont Ferrand court shall have sole jurisdiction.
10. PERSONAL DATA
L'Endormi reserves the right to collect personal information and data about you. This information is necessary to manage your order and improve the services and information we provide to you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and data concerning you, directly on the website.
11. EVIDENCE ARCHIVING
L'Endormi will archive rental contracts and invoices issued on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of L'Endormi will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
